These Terms & Conditions (“Terms”) govern your access to and use of the Taif Al Emarat Saudi Arabia online store (“Website”) and purchases made through the Website.
These Terms should be read together with our:
· Shipping & Delivery Policy;
· Return & Refund Policy; and
· Privacy Policy.
By placing an order through the Website, you agree to the applicable Terms presented in connection with the transaction.
Nothing in these Terms excludes, restricts, waives, or reduces any mandatory consumer right available under the laws and regulations of the Kingdom of Saudi Arabia.

2. Eligibility & Use of the Website
Customers must have the legal capacity required under applicable Saudi law to enter into the relevant transaction.
Where a person does not have full legal capacity, purchases should be made with the appropriate involvement or authorization of a parent, guardian, or other legally authorized person where required.
You agree not to:
· use the Website unlawfully;
· provide materially false information;
· impersonate another person;
· use payment information without authorization;
· interfere with Website security;
· attempt unauthorized access to systems or accounts;
· misuse promotions or discount codes fraudulently; or
· use the Website in violation of applicable Saudi law.
3. Product Information
We make reasonable efforts to ensure that product:

· sizes;
· ingredients or product information where applicable;

· prices;
· availability; and
· promotional information
are accurate.
Product packaging or presentation may occasionally vary due to legitimate manufacturer, regulatory, or packaging updates.
For fragrances, individual perception, performance, and longevity may vary depending on factors such as application, environment, storage, and individual characteristics.
Nothing in this section limits a customer’s rights where a product is defective, counterfeit, incorrectly supplied, materially different from its description, or otherwise non-conforming.
4. Prices & VAT
Product prices will be displayed in Saudi Riyals (SAR).
Applicable consumer-facing prices and charges will be displayed in accordance with Saudi requirements.
The applicable total price, including relevant taxes, delivery charges, and other required charges, will be communicated during checkout before the customer confirms the transaction.
Where VAT applies, it will be handled in accordance with applicable Saudi tax requirements.

5. Placing an Order
Before completing an order, customers will have an opportunity to review relevant information concerning:
· selected products;
· quantities;
· prices;
· applicable discounts;
· delivery charges;
· applicable taxes and fees;
· delivery information;
· payment method; and
· total amount payable.
Customers are responsible for reviewing this information and correcting errors before submitting the order.
6. Order Confirmation
After an order is submitted, the customer will receive an electronic acknowledgement or confirmation using the contact information provided during checkout.
Orders may remain subject to:
· product availability;
· payment authorization;
· fraud and security verification;
· accurate customer information; and
· applicable fulfilment requirements.
7. Order Cancellation by Taif Al Emarat
Taif Al Emarat may decline or cancel an order where reasonably and legally justified, including where:
· a product is unavailable;
· payment cannot be authorized;
· there is reasonable evidence of fraud or unauthorized payment;
· material customer information is incorrect;
· a material technical error affected the transaction;
· a genuine and obvious pricing error occurred; or
· completing the transaction would violate applicable law.
We will not use this provision arbitrarily to avoid fulfilling a valid consumer transaction.
Where a paid order is cancelled by Taif Al Emarat and reimbursement is due, the applicable amount will be refunded in accordance with applicable Saudi law and our Return & Refund Policy.
8. Payment
Available payment methods will be displayed during checkout and may include electronic payment methods and Cash on Delivery where offered.
By submitting payment information, the customer confirms that they are authorized to use the selected payment method.
Electronic payments may be processed through authorized third-party payment providers.
9. Shipping & Delivery
Online orders are currently delivered within the Kingdom of Saudi Arabia only.

Delivery remains subject to the detailed provisions of our Shipping & Delivery Policy.
Customers are responsible for providing complete and accurate delivery information.
10. Delivery Delays
Where delivery is materially delayed, Taif Al Emarat will comply with applicable requirements under the Saudi E-Commerce Law.
Where the statutory conditions for terminating an electronic contract because of delivery delay are satisfied, the customer may exercise the rights available under applicable Saudi law.

11. Returns, Cancellation & Refunds
Eligible online purchases may be subject to the statutory cancellation rights provided under the Saudi E-Commerce Law.
Subject to the applicable statutory conditions and exceptions, a consumer may have the right to terminate an eligible e-commerce contract during the seven (7) days following receipt of the product, provided that the product has not been used or benefited from.
Defective, damaged, counterfeit, incorrect, or non-conforming products are handled separately in accordance with applicable consumer rights.

12. Promotions & Discounts
Taif Al Emarat may offer:
· percentage discounts;
· fixed-value discounts;
· promotional codes;
· bundles;
· gifts with purchase;
· free-delivery promotions;
· seasonal campaigns;
· loyalty offers; and
· other promotions.
Each promotion may have specific conditions.
Material conditions should be clearly communicated and may include:
· campaign start and end dates;
· eligible products;
· excluded products;
· participating channels or stores;
· minimum spending requirements;
· maximum discount amounts;
· whether promotions can be combined;
· gift availability;
· stock limitations; and
· applicable redemption conditions.
Promotional conditions will not be used to remove mandatory consumer rights.
13. Promotional Codes
Unless otherwise stated in the applicable campaign conditions:
· promotional codes must be entered correctly during checkout;
· promotional codes may have an expiry date;
· minimum-spend conditions may apply;
· selected products may be excluded;
· a code may be limited to one use per customer or transaction where clearly stated; and
· multiple promotional codes may not be combinable.
The customer should be able to see the applicable discount before confirming the transaction.
14. Gifts With Purchase
Promotional gifts may be subject to:
· minimum spending requirements;
· eligible products;
· campaign dates;
· available stock; and
· other clearly communicated conditions.
Where a qualifying purchase is lawfully returned, the accompanying promotional gift may also need to be returned where applicable.
If the customer retains part of a promotional transaction, any resulting refund adjustment will be handled transparently and consistently with applicable law.
15. Advertising
We will make reasonable efforts to ensure that advertisements and promotions do not materially misrepresent:

· campaign periods;
· availability; or
· material conditions.
Material promotional conditions should be communicated clearly to consumers.
16. Product Availability
Product availability displayed on the Website may change.
If a product becomes unavailable after an order has been placed, we will make reasonable efforts to inform the customer.
Where payment has been collected for a product that cannot be supplied, the applicable amount will be refunded in accordance with applicable law and our Return & Refund Policy.

Unless otherwise stated, Website content including:

· graphics;
· text;
· videos;
· designs; and
· other protected material
is owned by or licensed to Taif Al Emarat and is protected by applicable intellectual-property laws.
Customers may use the Website for legitimate personal shopping purposes.
Unauthorized commercial copying, reproduction, modification, publication, distribution, or exploitation of protected content is prohibited except where authorized or legally permitted.
18. Product Reviews & Customer Content
Where customers are permitted to submit reviews or other content, the content must not:

· impersonate another person;
· infringe third-party rights;
· contain unlawful material; or
· contain malicious software or harmful technical content.
Taif Al Emarat may moderate or remove content where reasonably necessary for legal, security, or platform-integrity reasons.
We will not manipulate legitimate customer reviews in a manner intended to materially mislead consumers.
19. Privacy & Personal Data
Personal Data collected through the Saudi Website will be processed in accordance with our Privacy Policy and applicable Saudi data-protection requirements, including the Personal Data Protection Law and its Implementing Regulations.
Marketing consent is separate from transactional communications and will be handled in accordance with applicable requirements.
20. Third-Party Services
The Website may integrate services provided by third parties, including:

· analytics providers; and
· other service providers.
Where a third party independently provides a service directly to the customer, its applicable terms may also apply.
Nothing in this section removes Taif Al Emarat’s responsibilities where applicable Saudi law places responsibility on Taif Al Emarat.

Temporary interruption may occur because of:

· cybersecurity measures;
· technical problems;
· telecommunications failures; or
· circumstances outside our reasonable control.
Website interruption will not be used to unlawfully remove rights relating to an existing transaction.
22. Limitation of Liability
To the maximum extent permitted by Saudi law, Taif Al Emarat will not be responsible for losses resulting solely from circumstances outside its reasonable control or losses that are not reasonably foreseeable.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by Saudi law.
Nothing in these Terms limits mandatory consumer rights concerning defective, unsafe, counterfeit, incorrectly supplied, or non-conforming products.
23. Fraud & Security
Where there is reasonable evidence of:
· fraud;
· unauthorized payment;
· account misuse;
· deliberate promotional abuse;
· cybersecurity threats; or
· unlawful activity,
Taif Al Emarat may take proportionate steps to protect customers and the business, including transaction verification or suspension/cancellation where legally permitted.
Relevant information may be disclosed to payment providers, financial institutions, or competent authorities where permitted or required by law.
24. Electronic Communications
Order confirmations, invoices, delivery updates, account notifications, refund communications, and other transactional information may be provided electronically.
Customers are responsible for maintaining accurate contact information.
Transactional communications are separate from direct-marketing communications.
25. Consumer Complaints
Customers may contact Taif Al Emarat Customer Support regarding complaints concerning:

Nothing in these Terms restricts a consumer’s right to submit a complaint to the competent Saudi authorities.

These Terms and transactions conducted through the Saudi Website are governed by the applicable laws and regulations of the Kingdom of Saudi Arabia.
Any dispute will be subject to the competent authority or court having jurisdiction under applicable Saudi law.
Nothing in this section restricts mandatory consumer-protection rights or complaint mechanisms.
27. Consumer Rights
Nothing in these Terms is intended to exclude, restrict, waive, or reduce any mandatory right or remedy available to consumers under Saudi law, including applicable rights under the Saudi E-Commerce Law and its Executive Regulations.
Where these Terms conflict with a mandatory legal requirement, the applicable Saudi legal requirement will prevail.
28. Changes to These Terms
We may update these Terms where reasonably necessary to reflect changes in:
· applicable law;
· business operations;
· Website functionality;
· services; or
· policies.
Updated Terms will be published with a revised effective date.
Changes will not be applied retrospectively where doing so would unlawfully reduce rights arising from an existing transaction.
Where notification or consent is legally required, the applicable requirement will be followed.
